A cyclist was injured and taken to hospital Thursday after being struck by a vehicle at the intersection of Howard Avenue and Tecumseh Road East.
According to a Windsor news report, police say the cyclist failed to stop at a red light and has subsequently been charged. The cyclist’s injuries are not thought to be life-threatening.
Are Drivers Always Liable for Crashes Involving a Cyclist?
Vehicles are required to yield to cyclists, even if the rider does not have the right of way. However, if a cyclist fails to stop, a vehicle may not have sufficient time to brake and avoid hitting the rider. This incident helps to illustrate how drivers may not always be the liable party if a crash occurs.
Cyclists Must Follow Traffic Laws for Vehicles and Special Bicycle Rules
Under the Ontario Highway Traffic Act, bicycles are considered vehicles. What this means for cyclists is that they have all the same rights as drivers of motor vehicles. However, cyclists are also required to follow the same rules and traffic laws as motor vehicles.
Cyclists, like drivers, owe a legal duty of care to take reasonable measures to avoid causing harm to themselves and others. This means obeying traffic laws, using proper hand signals and paying attention to the road.
How Cyclists Can Avoid Crashes at Dangerous Intersections
Since bicycles offer little protection to riders, it is important to be aware of dangerous intersections in Windsor. Cyclists who choose to ride in these high-risk areas should be diligent to fully understand and follow special rules that only apply to bicycles. For instance, staying to the right side of the road and not riding within a crosswalk.
Here are some additional ways cyclists can ride safer through intersections in Windsor that are more hazardous:
- Be visible by wearing bright or reflective clothing.
- Use lights, even during the day.
- Obey traffic signals and signs.
- Use hand signals to indicate your intentions.
- Make eye contact with drivers when possible.
- Avoid blind spots of larger vehicles.
- Slow down and be prepared to stop at red lights, stop signs or to avoid a vehicle in the intersection.
- Be cautious of right-turning vehicles.
- Watch for opening car doors near intersections.
- Consider using bicycle lanes or paths when available, or opt for a safer route.
